General Terms and Conditions of CYBERTRIX VERLAG UG (limited liability), hereinafter referred to CYBERTRIX VERLAG.

 

Section I: General provisions

Your order represents an offer to us to conclude a contract of sale. On receipt of your order from cybertrix.de, a confirmation e-mail inform you of receipt of the order and again to confirm the details of the order. This order confirmation represents the information about your order and is not an acceptance of your offer. CYBERTRIX VERLAG leads your order through on the basis of these General Terms and Conditions (GTC). Changes to the Terms and Conditions, we reserve expressly. Deviating conditions of the contractor or licensee shall be recognized only with the written permission of CYBERTRIX VERLAG.

CYBERTRIX VERLAG can transfer its rights and duties under this Agreement to one or multiple third parties (contract transfer).


Conclusion of the contract
1) Obligations of the Client
The Client expressly assures all rights to place orders to possess. If by the contract rights of third parties, the Client shall be fully liable for this.

2) Price fixing
The selling price is often on a daily basis, set by publishers. Our information about products and prices during the ordering process given in good faith and belief, but can only be suggested due to the price-fixing.

3) Orders over cybertrix.de
A purchase agreement shall only come into being when we ship the ordered products to you and confirm the shipment to you with another e-mail (shipping receipt). About articles, which are not included in the shipping confirmation, no purchase contract is concluded.

4) The CYBERTRIX VERLAG offers no products for purchase by children.

5) Check the order confirmation for obvious writing and calculation errors and discrepancies between order confirmation and delivery You are obliged to notify us of any discrepancies immediately. If the reversal is necessary because of a disagreement of your or our site, do not open the product, but send the goods back to our address stated on the delivery note.

6) Media products (DVDs, videos, audio tapes, CDs, software ) we only sell in small amounts.


Delivery
1) The delivery ex warehouse to the specified Delivery address by you, unless otherwise agreed.

2) We are entitled to make partial deliveries .

3) Information about the delivery time shall only be binding if we have you explicitly guaranteed a certain delivery date.



Returns
For deliveries within Germany we charge a flat rate shipping costs (see shipping). Partial or deliveries are free shipping.
Deliveries outside of Germany are agreed separately.

Terms of Payment
Buyer is for new customers, the obligation to advance payment of the invoice ( payment in advance ) .

Delivery and registration fees as well as courier, couriers, Quick Lunches and bulky goods shall be charged separately .

In the case of return or dishonor a direct debit, especially after objection, authorize and instruct your bank irrevocably us or a service provider authorized by us to share your current address. All fees incurred (rear load fees of the Bank and address information ) in connection with unredeemed debits shall be borne by the customer.

Customs
Duties or import fees may apply in the destination country for delivery abroad. Such costs are at your expense and we have no control over these charges and can not give information about your height. Customs policies vary widely from country to country. If you would like more information about it, please contact best with your local customs office. Please note that you must comply with as an importer the appropriate local regulations.

Shipping damage, defects
Should the goods be defective, you complain it immediately. We encourage you to seek obvious damage confirmed by the parcel delivery.

 

Section II: Additional Special Rules for Licensing

This agreement contains the terms and conditions pursuant to which the CYBERTRIX VERLAG you the license to use the U in a circle - offers EAC / RN 009054421 - OHIM registration. By use of the logo and / or by registering, you agree to the terms of this agreement.

2) Corporations, agencies, institutions and public bodies may only register with an official name and address, as well as the data of authorized signators. Corporations, agencies, institutions and public bodies may receive several licensees numbers in exceptional cases.

3 ) The registration for Urheberrecht holder (authors) is free.

4) The permission for using zhe symbol U in circle will be awarded solely for use according to the terms of this Agreement under license, and is not sold. The CYBERTRIX VERLAG reserves all rights that are not expressly granted to you.

5 ) The licensee guaranteed, beeing actually the author of the works, that he denotes with U in circle icon.

6) A licensee of an agency, publisher or other marketers attaching the U in circle   - icon mandated by an Urheberrecht author, guaranteed to be actually authorized by the author.

7) With this registration you may all works where the copyright is your responsibility to bear the sign in order to indicate their copyright protection.

8) The licensee guarantees and warrants that he uses the U in circle - symbol only in accordance with the license terms.

9) The affixing of the sign must not lead to confusion with other symbols, icons, protected trademark or service mark or sovereign symbols.

10) The license for using the U in circle symbol, is not bound to another service ( service I or II).

License

Start, duration and end of the license

1) Start the license
The license begins after your registration and the allocation of licensee number.

2) License period
The license duration is undetermined and subject to any conditions which are fundamentally instrumental for licensing and for the duration.

3) License termination
The license ends with the return of the license by the licensee, the termination of the license by the licensor or by changing the law conditions that have led to the licensing. The license will automatically be ended in breach of the obligations of the Licensee under this License Agreement or misuse of the trademark.

In these countries, other symbols may come to be used, on its introduction, the parties will be informed by the licensor. In these countries, the plants can also be provided with an indication u.cybertrix.com in connection with the license number.

Withdrawal - beginning
You may revoke your contractual declaration within two weeks without giving reasons in writing (eg letter, email) and by returning the goods. A right is not in the cases referred to in  § 312 d Abs, 4 BGB thus in particular not in the delivery of audio or video recordings or software if the delivered data carriers have been unsealed by you.

Consequences of revocation
In case of an effective cancellation the mutually received benefits are to be returned and any benefits (eg interest) surrendered. Can you give us the performance received whole or in part, or return them in a deteriorated condition, you must pay us compensation for the value.
